Association Events Brienz «HotPot Brienz»
1. General
These General Terms and Conditions (hereinafter "GTC") govern the conclusion, content, and execution of contracts for the use of services provided by the association Events Brienz «HotPots Brienz» (hereinafter "Organizer"), which are offered on the website www.hotpot-brienz.ch.
By booking, the customer acknowledges these GTC. Deviating terms and conditions of the customer are excluded.
By clicking the checkbox: "I have read and accept the GTC," the ticket purchaser and voucher purchaser declare that they acknowledge and will comply with the GTC.
For reasons of readability, these GTC refrain from using male, female, and diverse forms simultaneously. All personal designations apply equally to all genders.
2. Conclusion of Contract
The Organizer offers its services on the website. The customer books the desired service via the online booking system. By submitting the booking, the customer accepts the GTC. The contract is deemed concluded as soon as the Organizer confirms the booking by e-mail.
3. Personal Data
3.1 The ticket purchaser acknowledges and agrees that the Organizer and its suppliers may gain access to personal data in connection with the provision and maintenance of the system and the performance of services. This personal data will be used in the context of ticket purchases and access control, insofar as it is useful for the event.
3.2 The Organizer may further use personal data for its own purposes in compliance with all legal requirements.
3.3 The Organizer undertakes to use or disclose personal data to third parties outside the Organizer only with the express consent of the ticket purchaser and in compliance with all legal requirements.
4. Payment
Payment is made at the time of contract conclusion via credit card, TWINT, or other specified payment methods. The customer undertakes to make payment on time. In case of default, the customer owes default interest of 5% as well as a reminder fee of CHF 50.00 per reminder.
5. Cancellation
5.1 For cancellations up to 10 days before the booked date, the customer will receive a voucher equal to the total amount.
5.2 For cancellations up to 3 days before the booked date, the customer will receive a voucher equal to 50% of the total amount.
5.3 For cancellations later than 3 days before the booked date, no refund of the total amount will be given.
6. Rebooking or Postponement
6.1 Rebookings or postponements less than 3 days before the booked date are excluded.
6.2 In case of rebookings, cancellations, or postponements due to illness, a medical certificate must be presented. The customer will receive a voucher equal to the total amount.
6.3 A maximum of one rebooking or postponement is possible per booking.
6.4 Rebookings are only possible within the current season.
6.5 Cancellations, postponements, or rebookings must be reported exclusively in writing by e-mail to info@brienz-tourismus.ch.
7. Vouchers
7.1 Ordered vouchers are valid for 10 years from the date of issue. A cash payout is excluded.
7.2 In case of loss, damage, or theft, the Organizer assumes no liability. The voucher cannot be replaced in this case.
7.3 Redemption is subject to availability and the respective applicable booking conditions.
7.4 The issued vouchers are value vouchers. Should the Organizer close or cease operations for any reason, the vouchers will expire without entitlement to a refund or compensation. This also applies if the business demonstrably changes ownership. In such a case, the Organizer as the original issuer of the vouchers cannot be held liable.
7.5 Vouchers are sent by B-Post within five working days to the postal address provided by the customer. The Organizer cannot be held liable for incorrect or delayed delivery not caused by it.
7.6 Risk and responsibility pass to the customer at the time of dispatch from the Organizer’s location.
8. Ownership, Possession, and Intellectual Property Rights
Items used by the customer (towel, bathrobe, etc.) remain the property of the Organizer. In case of loss or damage, the following flat fees will be charged:
– Towel: CHF 40.00
– Bathrobe: CHF 80.00
9. Safety and Liability
9.1 The use of the HotPot facility is at the customer’s own risk. Insurance is the responsibility of the participants. The facility is deliberately dimly lit to create a special atmosphere – this requires guests to take increased personal responsibility.
9.2 There is no supervision or lifeguard service. The Organizer declines all responsibility for incidents resulting from improper use or lack of supervision.
9.3 The Organizer is not liable for accidents, injuries, or health damages caused by the customer’s own fault, disregard of instructions, or improper use. This applies in particular to the use of the HotPots and direct access to the lake.
9.4 The Organizer’s liability is excluded to the extent permitted by law. In particular, liability for slight negligence is rejected.
9.5 The Organizer assumes no responsibility for actions or accidents in the lake or outside the rented area.
9.6 Physical complaints / circulatory problems: Use of the HotPot and lake access may cause circulatory strain due to heat, temperature changes, or physical exertion. Persons with health conditions (e.g., cardiovascular diseases, dizziness, high blood pressure, pregnancy, etc.) use the facilities at their own risk. In case of doubt, prior consultation with a doctor is advised. The Organizer accepts no liability for health incidents.
9.7 Consumption of alcohol: The consumption of alcohol is permitted within the HotPot experience but is at the guest’s own risk. Guests are solely responsible for safe and responsible handling of alcohol. The Organizer declines any liability for alcohol-related accidents, damages, or health impairments.
9.8 Bringing food and drinks / operation of HotPots: Bringing and consuming own food and drinks is not permitted. Exceptions require the Organizer’s express written consent before the event. The HotPots are operated exclusively by the Organizer’s staff. In case of non-compliance, the Organizer reserves the right to expel guests from the premises or to terminate the service prematurely. A refund of the booking amount is excluded in this case.
9.9 The Organizer is not liable for damages resulting from the use of the Organizer’s websites due to disturbances, interruptions, or overloads of the IT system on the part of the Organizer, its suppliers, or the user. For misuse and unlawful interference in the system, the Organizer rejects any liability for damages.
10. Data Protection
The current data protection regulations of the Organizer, available at https://shop.e-guma.ch/HotPot-brienz/de/tickets/privacypolicy, apply. They form an integral part of these GTC.
11. Changes
The Organizer reserves the right to change these GTC at any time.
12. Cancellation by the Organizer
12.1 The Organizer reserves the right to cancel bookings at short notice for safety or technical reasons (e.g., storms, storm warnings, damage to the facility, power failure, force majeure).
12.2 In this case, a voucher equal to the booked total amount will be issued.
12.3 The Organizer assumes no liability for already incurred travel, accommodation, or other incidental costs.
13. Place of Jurisdiction
The exclusive place of jurisdiction for all disputes between the Organizer and the customer is Thun (BE), Switzerland.
