AGB Voucher - Terms of purchase and delivery

I. APPLICATION TO CONSUMERS AND DEFINITION OF TERMS
(1) The following General Terms and Conditions shall apply to all deliveries between us and a consumer in the version valid at the time of the order.

(2) "Consumer" within the meaning of these Terms and Conditions is any natural person who enters into a legal transaction for a purpose that can be attributed neither to his commercial nor to his independent professional activity.

II. CONCLUSION OF A CONTRACT, STORAGE OF THE CONTRACT TEXT

(3) The presentation of the vouchers in our Internet store does not constitute a legally binding contract offer on our part, but is only a non-binding invitation to the consumer to order vouchers. By ordering the desired voucher, the consumer makes a binding offer to conclude a purchase contract.

(4) Upon receipt of an order in our voucher store, the following rules apply: The consumer makes a binding offer to enter into a contract by successfully completing the order procedure provided in our voucher store.

The order is placed in the following steps:
1) Selection of the desired voucher
2) Specify the amount
3) Personalize your voucher
4) Select a shipping method
5) Select quantity and continue by clicking the "Add to cart" button
6) If you want to select another voucher, click on the desired category and repeat steps 1-5.
7) Check the data in the shopping cart
8) Continue with button "Order
9) Enter billing / delivery address and contact details
10) Select payment method, if credit card is selected, enter the credit card data.
11) Check again or correct the data you have entered.
12) Read through the terms and conditions and confirm with a check mark
13) Read through the revocation declaration and confirm with a check mark.
14) Costly and binding sending of the order

Before the binding submission of the order, the consumer can, after checking his data, return to the Internet page on which the customer's data are recorded and correct input errors or cancel the ordering process by closing the Internet browser by pressing the "Back" button contained in the Internet browser used by him. We confirm the receipt of the order immediately by an automatically generated e-mail ("order confirmation"). With this we accept your offer.

For security reasons, your order data is no longer accessible via the Internet.

III. PRICES, SHIPPING COSTS, PAYMENT, DUE DATE
(1) In order to keep the order costs as low as possible, you can pay the vouchers directly by credit card or online bank transfer to have the voucher sent to you free of charge by e-mail. However, the vouchers can also be sent by post. For postal dispatch we charge a handling fee.

(2) The indicated prices contain the legal value added tax and other price components, a settlement takes place with the use of the service. Shipping costs and design costs are added if the shipping method "send by mail" is selected.

(3) The purchased vouchers with the respective total value including VAT cannot be redeemed in cash. If the consumption is less than the value of the voucher, you will receive another credit note.

(4) No liability is accepted for late delivery by post.

(5) The voucher is only valid when the amount due has been paid in full.

IV. DELIVERY
The vouchers can be printed out immediately by the consumer himself. If the shipping method "send by mail" is selected, a high-quality voucher with envelope will be sent to the consumer by mail. A handling fee for postage and packaging of 5.00 euros will be charged for mailing. If the payment method is "bank transfer", the voucher will only be sent after receipt of payment in the selected shipping method.

V. RESERVATION OF OWNERSHIP
We reserve the right to redeem the voucher until full payment of the purchase price.

VI. VALIDITY
Vouchers remain valid for 3 years from the date of purchase and are provided with a unique serial number that is required to redeem the voucher. Each voucher can be redeemed only once.

VII. REDEMPTION
The holder of the voucher can redeem it for all hotel services offered in the hotel, these are considered as currency exchange 1 voucher Euro = 1 hotel Euro. Excluded are pick-up services or delivery services colloquially called "To-Go" or "Take-Away".

VIII. LOSS
In case of loss, theft or theft of vouchers, no compensation can be provided.

IX. DEVIATIONS AND ERRORS
Deviations in illustrations of the goods for sale are possible. Errors and changes of the articles reserved.

X. SECURITY GUARANTEE & DATA PROTECTION
(1) The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and according to the legal data protection regulations.
When you use this website, various personal data are collected. Personal data is data with which you can be personally identified. This data is not passed on to third parties. We would like to point out that data transmission on the Internet (e.g. when communicating by e-mail) can have security gaps. A complete protection of data against access by third parties is not possible.

XI. MANDATORY INFORMATION ACCORDING TO THE REGULATION (EU) NO. 524/2013 OF THE EUROPEAN PARLIAMENT AND COUNCIL:

We are obliged to settle disputes with consumers before the following consumer arbitration board. XII. CONTRACTUAL LANGUAGE
German shall be the sole language of the contract.

XIII. PLACE OF PERFORMANCE, PLACE OF JURISDICTION AND LEGAL SYSTEM
For contracts with merchants, legal entities under public law and special funds under public law, the place of performance for delivery and payment as well as the place of jurisdiction is agreed to be Freiburg; however, the supplier is also entitled to file suit at the place of the consumer's registered office or a branch office. If the consumer does not have a general place of jurisdiction in Germany or if he moves his place of residence or usual place of abode outside the area of validity of the Federal Republic of Germany after conclusion of the contract, the place of jurisdiction shall be the supplier's place of business. This also applies if the consumer's place of residence or habitual abode is not known at the time the action is brought.
The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. Should any provision of these terms and conditions and the further agreement reached be or become invalid, this shall not affect the validity of the remaining terms and conditions.
