General provisions
The ticket purchaser ("Ticket Purchaser") recognizes that ordering tickets and/or the use of other offered services shall give rise to rights and obligations exclusively between: Stiftung Gurten – Park im Grünen ("Organizer") and the Ticket Purchaser. This applies in particular to any claims for restitution.
These General Terms and Conditions ("T&C") form the basis for the use of the organizer’s website.
By ticking the checkbox: «I have read and accept the T&C», the Ticket Purchaser declares his/her acceptance of and adherence to the T&C.
Provisions of the Organizer and validity and return of tickets
The provisions of the Organizer (security requirements, age and other entry restrictions, etc.) must be adhered to. Any misuse of the tickets is prohibited. The Ticket Purchaser must ensure that the ticket being protected against misuse (e.g. wrongful copying, modification or printing by unauthorized persons). The QR code and/or barcode must be machine-readable.
Tickets can generally not be returned or exchanged. If events are postponed, the tickets are automatically valid on the new date. If an event is cancelled, the Ticket Purchaser’s repayment claim against the Organizer is subject to his Terms and Conditions.
Personal data
The Ticket Purchaser acknowledges and agrees that the Organizer and his suppliers may obtain knowledge of personal data as part of their provision and maintenance of the system and the provision of services. These personal data are, to the extent relevant for the event, used for ticket purchasing and access control.
The organizer shall be permitted to continue using the personal data or their own purposes in compliance with all regulations.
The organizer commits to only continue to use the personal data, or forward them to third parties besides the Organizer, following the express consent of the Ticket Purchaser in accordance with all legal proisions.
Disclaimer of liability
The organizer shall not be held liable for damages arising from the use of the Organizer’s website in case of errors, interruptions or overloads of the IT systems on the part of the Organizer, his suppliers or the user. The organizer does not accept any liability for misuse and unlawful interference in the system.
Exclusion of liability for sporting events
The organiser accepts no liability for injuries and damage in connection with sporting activities. With the purchase of the ticket, each participant assures that he/she assumes responsibility for his/her own actions. Liability for property and valuables is also not accepted.
(ExtraTerms) Final provisions
The organizer reserves the right to modify these Terms and Conditions at any time without stating reasons. Such changes do not apply for orders that have already been placed at that point in time. Should one provision of these Terms and Conditions be or become void, the validity of the remaining agreement shall not be affected thereby. The place of jurisdiction is Bern.
